The Plenary of the Federal Telecommunications Institute (“IFT”) resolved… the technical conditions for interconnection between concessionaires, and determined the interconnection rates to be used in the event of disagreements.
The Plenary of the IFT unanimously resolved that the concessionaires must pay the Preponderant Economic Agent (“AEP”) the following rates:
- For termination in the mobile network of the AEP for Local Service in users under the “calling party pays” modality: $0.028562 pesos per minute of interconnection.
- For short message termination services (SMS) for mobile users: $0.007269 pesos per message.
- For Local Service origination services for fixed users: $0.003092 pesos per minute of interconnection.
- For transit services: $0.003809 pesos per minute.
The interconnection rates to be paid to concessionaires other than the AEP will be as follows:
- For termination in the mobile network for Local Service in users under the “calling party pays” modality: $0.112799 pesos per minute of interconnection.
- For short message termination services (SMS) for mobile users: $0.017355 pesos per message.
- For Local Service termination services for fixed users: $0.002836 pesos per minute of interconnection.
- For short message termination services (SMS) for fixed users will be $0.016082 pesos per message.
The resolution of the Plenary of the IFT will be published in the Official Journal of the Federation (“DOF”) in the next few days, and will become effective as of January 1, 2018.
With the above resolution, the IFT exercised its authority to asymmetrically regulate telecommunications service concessionaires in order to eliminate barriers to free competition, and complies with the ruling of the Supreme Court of Justice of the Nation in the “Zero Tariff” case already analyzed.
