On February 11, 2025, the Federal Telecommunications Institute (“IFT”) approved modifications to the Guidelines for the Commercialization of Mobile Services by Mobile Virtual Network Operators (the “Modifications”). These Modifications aim to ensure service continuity for users if an MVNO ceases operations, particularly after the dynamic changes in the Mexican MVNO market and the exit of several MVNOs between 2020 and 2022.
The new obligations, effective on April 14, 2025, are detailed below:
- User notification: MVNOs must notify users 30, 15, and 5 days in advance of service termination, providing the termination date, number portability rights, and alternative operators. The Mobile Wholesale Operator (the “Operator”) must also be notified.
- Service continuity: The Operator must ensure basic functionalities, including fault handling, emergencies, and maintenance.
- Portability and emergency services: If users are not fully migrated, the Operator must guarantee portability and emergency calls for 40 days. MVNOs with infrastructure must provide technical user data to the Operator.
- Temporary services: The Operator will only provide connectivity for portability, emergency calls, and related inquiries.
- Reporting to IFT: The Operator must notify the IFT of the MVNO’s cessation and inform users about service continuity and portability deadlines.
- Portability messages: MVNOs must send SMS notifications to users at three intervals: within the first 10 days, on day 20, and 72 hours before line deactivation.
- Service limitations: The Operator cannot offer telecommunications services to MVNO users, only ensure basic user rights.
