On September 28, 2018, the decree promulgating the Convention for the Protection of Individuals with respect to the Automated Processing of Personal Data, entered into between Mexico and France, was published in the Official Gazette of the Federation.
The purpose of this convention is to guarantee to any natural person, whatever his nationality or residence, respect for his fundamental rights and freedoms in the field of data protection, specifically the right to privacy, with respect to the automated processing of personal data concerning him in the territory of the contracting countries.
With respect to the management of personal data, the agreement establishes fundamental principles concerning data quality, information security, complementary guarantees for the person involved, as well as exceptions and restrictions.
In the case of transborder flows of personal data between contracting countries, it establishes that these may not be restricted unless specifically regulated by domestic legislation.
This agreement entered into force on October 1 of this year, and therefore, as of that date, it became mandatory for the contracting countries.
