On January 6, 2026, the Agreement whereby the Plenary of the Telecommunications Regulatory Commission approves and issues the 2026 Annual Program for the Use and Exploitation of Frequency Bands (the “Program”) was published in the Official Gazette of the Federation (in Spanish, “DOF”). The Program entered into force on the date of its publication in the DOF, in accordance with its transitory provisions.
The Program was issued pursuant to Article 37 of the Telecommunications and Broadcasting Law, which provides that the Telecommunications Regulatory Commission (the “Commission”) shall issue, no later than December 31 of each year, the annual program for the use and exploitation of frequency bands, identifying the frequencies or frequency bands of determined spectrum that will be subject to a government tender or may be directly assigned. Such program shall include, at a minimum, the services that may be provided through such frequencies or frequency bands, their category, the applicable modes of use, and the corresponding geographic coverage.
The purpose of the Program is to determine the frequencies and frequency bands of determined spectrum that may be directly assigned or subject to government tender, and to classify them according to their mode of use, specifying, in each case, the basic characteristics associated with each band, including: the service to which they are allocated, the geographic coverage in which such service will be made available, and the category of radiocommunication service to which they are attributed. Such frequency bands may be granted for commercial use through government tender procedures or directly assigned when intended for public, private, or social use.
In accordance with the Program, the frequencies and frequency bands intended for commercial use that will be subject to government tender will be considered in future tender procedures in the short and medium term, although not necessarily during 2026, taking into account the planning and resources of the Commission to carry out such procedures in the coming years.
